RECITALS
WHEREAS, Owner holds title to the real property described herein; and
WHEREAS, Owner desires to engage Agent to provide limited, specialized services related to recovering legal possession of the Property from tenants; and
WHEREAS, Agent is experienced in the management of eviction proceedings and is willing to provide such services to Owner under the terms set forth herein.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties agree as follows:
1. SUBJECT PROPERTY

(Hereinafter referred to as the "Property").
2. APPOINTMENT AND AUTHORITY OF AGENT
Owner hereby appoints Agent as its sole and exclusive limited agent to manage the eviction and possession recovery process for the Property. Agent's authority is strictly limited to matters necessary for the legal recovery of possession, including but not limited to:
- Preparing and serving legally required notices to tenants.
- Filing Failure to Pay Rent complaints, Breach of Lease actions, and other summary ejectment proceedings in the appropriate District Court of Maryland.
- Representing Owner in court hearings and settlement conferences as Owner's authorized agent.
- Negotiating settlement agreements, consent judgments, and stays of eviction as deemed strategically necessary and appropriate by Agent, in accordance with the separate Authorization for Settlement and Negotiation form.
- Coordinating with law enforcement for the execution of a Warrant of Restitution.
3. COMPLIANCE WITH LAW
Agent shall perform all services in strict compliance with all applicable federal, state, and local laws, including but not limited to the Maryland Landlord and Tenant Law, the Federal Fair Housing Act, and Maryland's Just Cause Eviction statutes. Agent will only initiate eviction proceedings based upon a legally sufficient cause provided by the Owner.
4. TERM OF AGREEMENT
This Agreement shall commence on the date first written above and shall remain in effect until the legal possession of the Property is recovered, or until terminated by either party with seven (7) days' written notice to the other party.
5. COMPENSATION
Owner agrees to compensate Agent for services rendered based on the Agent's current schedule of fees. Services are itemized and billed upon Owner's request for specific actions. Owner acknowledges that court filing fees and other legal costs are separate from Agent's service fees and are the responsibility of the Owner.
6. OWNER'S RESPONSIBILITIES & COVENANTS
Owner agrees to:
- Provide Agent with all necessary, accurate, and truthful documentation and information required for the eviction process, including but not limited to the lease agreement, tenant ledgers, and proof of property licensing/registration.
- Warrant that the reason for any requested eviction constitutes a "just cause" under current Maryland law and provide factual evidence supporting such cause.
- Communicate any specific instructions or preferences regarding the eviction in a timely manner.
- Remain available for consultation during the process and promptly respond to requests for information or decisions from the Agent.
- Pay all Agent fees and court costs as they become due.
7. LIMITATION OF LIABILITY
Agent shall not be liable for any damages, losses, or claims arising from actions taken in good faith and without negligence under this Agreement. Agent's liability shall be limited to instances of gross negligence or willful misconduct. Agent is not a law firm and does not provide legal advice; Agent's services are procedural and representative in nature. Owner is encouraged to seek independent legal counsel for legal advice.
8. INDEMNIFICATION
Owner agrees to indemnify, defend, and hold harmless the Agent, its officers, and employees from and against any and all claims, demands, losses, liabilities, and damages (including attorneys' fees and costs) arising out of or in connection with this Agreement, including claims arising from the Owner's actions, omissions, misrepresentations, or failure to provide a legally sufficient cause for eviction.
9. GOVERNING LAW AND ENTIRE AGREEMENT
This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland. This document, along with the Authorization and Expectation Acknowledgement form, constitutes the entire understanding between the parties and supersedes all prior discussions or agreements.
